These Terms of Use (“Terms”) govern access to and use of the websites miavita.ch, app.miavita.ch, and any related digital applications, platforms, or online services operated by:

(collectively, the “Platform”).
Our company, miavita GmbH is an independent insurance broker registered with the Swiss Financial Market Supervisory Authority (FINMA).
Individual insurance advisors of miavita GmbH are FINMA registered when required by law. To verify your miavita advisor, please visit https://www.finma.ch/en/authorisation/insurance-intermediaries/registersuche/.
By accessing or using the Platform, creating an account or submitting information on the Plattform, you accept these Terms in full.
If you do not agree to these Terms, you must not access or use the Platform.
The Platform is intended exclusively for natural persons of legal age residing in Switzerland.
Services, comparisons and any benefits offered via the Platform apply exclusively to eligible Swiss insurance policies. Insurance policies governed by foreign law or issued outside Switzerland are not supported.
miavita GmbH acts as an independent insurance intermediary and is registered in the intermediary regiser of FINMA as an independent broker.
miavita is not an insurance company and does not underwrite insurance policies.
Any offers or calculations via the platform and miavita advisors are non-binding offers.
Insurance contracts are concluded exclusively between you and the respective insurance company. Insurers remain solely responsible for underwriting decisions, policy terms, premium calculation and claim assessments.
The Platform provides:

Insurance comparison services for basic (KVG) and supplementary (VVG) health insurance.

Personal user account & policy wallet for the secure overview and management of your insurance policies.

Contests or sweepstakes, cashback or reward programs (where offered and subject to separate conditions).

The option to request insurance advice and to be contacted by miavita advisors.

News, notifications about new insurance documents and insurance offers as part of broker and policy wallet service.

AI-based features, including policy analysis and insurance themed chatbot. Such tools are provided for informational purposes and improving user experience only and do not constitute binding offers or guarantees of coverage.

The possibility to grant a digital broker mandate authorising miavita to represent you towards insurers

The possibility to submit insurance-related requests or claims to insurers for which a valid broker mandate has been granted.
miavita grants users the right to access and use the Platform in accordance with these Terms. The right to use the Platform is personal, non-exclusive, non-transferable, and may be revoked at any time.
miavita may restrict, suspend or terminate access to the Platform in whole or in part where required for legal, security, operational or regulatory reasons, particularly in cases of misuse.
Access to and use of the Platform services is free. If any fee-based service is introduced, users will be informed in advance.
Users must:

Provide truthful, accurate and complete information

Comply with all applicable laws and regulations

Keep login credentials and access data confidential and protect them against unauthorised access.

Immediately inform miavita of any suspected unauthorised use.

Regularly review and update their account information.

Not misuse the Platform or attempt to manipulate comparison results or other functionalities.

Not interfere with the proper functioning or security of the Platform.

Not upload or transmit malicious software or harmful code.

Not use the Platform for unlawful or fraudulent purposes.

Not share login credentials with third parties.
Users are responsible for any consequences resulting from unauthorised access caused by failure to adequately protect their login credentials.
Information provided on the Platform, including premium calculations and comparisons, AI-based responses and other content:

Does not constitute a binding offer or contractual commitment;

Is provided for informational purposes;

May be based on public and / or data provided by insurers without guarantee of completeness or accuracy or timeliness;

Does not replace legally required policy document, general terms and conditions or product information issued by a respective insurer.

Is not a guarantee of coverage or acceptance by an insurer.

Users must read and verify details before concluding contracts.
Insurance contracts are concluded exclusively between the user and the respective insurance provider.
miavita acts as an independent insurance intermediary in cooperation with Swiss insurance providers. Insurance contracts are concluded with insurers, not with miavita.
miavita does not itself provide insurance coverage, facilitate underwriting processes and is not an insurance company.
The Platform includes AI-based functionalities, including an insurance chatbot and a policy analysis tool. These tools are designed to:

Provide general insurance-related information

Support users in navigating available options

Assist in pre-selection and comparison of insurance products

Extract and process information from documents uploaded by users to improve the user experience.
AI-based features operate through automated processing and are provided for informational and support purposes only.
AI-generated outputs:

Do not constitute legally binding advice or recommendations

Do not replace personalised consultation by a qualified advisor

May be incomplete, inaccurate or based on the information provided by the user

Do not constitute a guarantee of coverage, suitability or insurer acceptance.
Users remain solely responsible for reviewing and verifying information before submitting applications or making insurance decisions.
The Platform may use automated translation tools and language processing technologies to provide multilingual content and document analysis.
Translations and automated language outputs are provided for convenience only and may contain inaccuracies or omissions. In case of discrepancies, the original version of a document or the official documentation issued by the respective insurer shall prevail.
miavita does not guarantee the accuracy or completeness of automated translations.
Access to certain services of the Platform requires the creation of a personal user account.
When registering an account, users agree to:

Provide accurate, current and complete information

Maintain and promptly update their account information

Keep login credentials confidential and protect them from unauthorised access

Immediately notify miavita of any suspected unauthorised use of their account.
Users are responsible for all activities carried out under their account, unless they have duly notified miavita of unauthorised access.
The Platform may offer optional login via third-party authentication providers (e.g. Google or Meta). Use of such services is voluntary and subject to the respective provider’s terms and privacy policies. miavita is not responsible for the operation or security of third-party authentication services.
miavita may restrict, suspend or terminate user accounts in cases of misuse, security concerns, or legal or regulatory requirements.
By using the Platform, you agree that documents, notifications and other communications may be provided electronically, including through your user account on the Platform or via your registered email address.
miavita may provide copies, summaries or notifications of insurer communications for convenience only. Such communications do not replace official correspondence issued by the respective insurance company. In case of discrepancies, the insurer’s original documents and terms shall prevail. Electronic communications are deemed delivered when they are made accessible in your user account or sent to the email address registered with your account.
Users are responsible for ensuring that their contact details are accurate and up to date, and for regularly reviewing their user account and email inbox (including spam or junk folders).
miavita is not responsible for delivery failures resulting from incorrect contact details, technical issues outside its control, or failures of third-party communication providers.
Where required by law or deemed appropriate, miavita may deliver documents by post at no additional cost to the user.
The processing of personal data is governed by the miavita Privacy Policy, which forms an integral part of these Terms.
Personal data is processed in accordance with applicable data protection laws, including:

The Swiss Federal Act on Data Protection (DSG);

The EU General Data Protection Regulation (GDPR), where applicable.

Retention periods are defined in the Privacy Policy.
miavita may offer cashback, referral rewards or other incentive programs from time to time. Participation in such programs is voluntary and subject to specific eligibility criteria and program conditions.
Eligibility may depend on:

Successful conclusion and activation of an eligible insurance policy;

Maintenance of the policy for a minimum period, where specified;

Accurate and truthful information provided by the user.
Cashback or rewards may be withheld or reclaimed in cases of cancellation within a defined period, misrepresentation, abuse, or violation of these Terms.
miavita reserves the right to modify, suspend or discontinue incentive programs at any time. Changes shall not affect rewards that have already been validly earned in accordance with the applicable program conditions.
Program-specific terms and eligibility criteria are published on the relevant pages of the Platform.
All content and materials available on the Platform, including but not limited to text, graphics, logos, design elements, software, databases, algorithms, comparison methodologies, AI models, and branding (collectively, the “Content”), are the property of miavita or its licensors and are protected by intellectual property laws.
Users are granted a limited, non-exclusive, non-transferable right to access and use the Platform solely for personal, non-commercial purposes in accordance with these Terms.
Any reproduction, modification, distribution, publication, reverse engineering, scraping, automated extraction, or other use of the Content without prior written consent of miavita is prohibited.
miavita strives to ensure continuous availability and proper functioning of the Platform. However, miavita does not guarantee uninterrupted access, error-free operation, or compatibility with all devices or software environments.
Access to the Platform may be temporarily restricted due to maintenance, updates, security measures, technical issues, or events beyond miavita’s reasonable control.
miavita does not assume liability for temporary unavailability of the Platform.
To the extent permitted by applicable Swiss law, miavita excludes liability for indirect, incidental, special or consequential damages, including loss of profit, loss of opportunity or loss of data.
miavita shall not be liable for:

Decisions made by users based on information provided via the Platform, including AI-generated outputs

Underwriting, premium calculation, coverage determinations or claim decisions made by insurers;

Temporary unavailability, technical malfunctions or compatibility issues of the Platform

Inaccuracies or incomplete information resulting from data provided by users or third parties, including insurers.

Errors or inaccuracies resulting from automated processing, AI or machine translations.
Users may cease using the Platform and close their account at any time.
miavita may restrict, suspend or terminate access to the Platform, in whole or in part, in particular in cases of:

Violation of these Terms;

Misuse of the Platform;

Security concerns

Legal or regulatory requirements.
Termination or restriction of access to the Platform does not affect rights or obligations that have arisen prior to such termination.
Termination of access to the Platform does not affect the validity of insurance contracts concluded with insurers or any broker mandate previously granted, unless separately revoked in accordance with applicable terms.
miavita may amend these Terms from time to time for legal, regulatory, operational or technical reasons.
Users will be informed of material changes in an appropriate manner, including via the Platform or by email.
Unless otherwise stated, amended Terms enter into force upon publication. Continued use of the Platform after the effective date constitutes acceptance of the amended Terms.
Amendments shall not affect rights or obligations that have arisen prior to the effective date of the changes.
These Terms and any disputes arising out of or in connection with them shall be governed by substantive Swiss law, excluding conflict of law provisions.
The exclusive place of jurisdiction shall be Olten, Switzerland, unless mandatory statutory provisions provide otherwise.
If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the economic intent of the original provision.
These Terms govern the use of the Platform and constitute the entire agreement between the user and miavita in relation to such use.
They do not affect separate contractual relationships, including broker mandates between the user and miavita or insurance contracts concluded between the user and an insurer.
